Terms of Service

These Terms of Service (“Terms”) govern access to and use of the StackedAI platform, websites, APIs, software, tools, and related services (collectively, the “Services”) provided by AUMX LLC (“StackedAI,” “Company,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be legally bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Services

StackedAI provides modular artificial intelligence infrastructure, agent frameworks, structured cognition systems, logging tools, automated publishing systems, governance layers, and related software platforms.

Services may include:

  • AI-generated outputs
  • Structured automation and reporting
  • Memory logging and traceability systems
  • API integrations
  • Enterprise workflow orchestration

StackedAI reserves the right to modify, suspend, or discontinue any portion of the Services at any time.

3. Artificial Intelligence & Automated Systems

The Services utilize artificial intelligence systems that generate outputs algorithmically.

You acknowledge and agree:

  1. Outputs may be inaccurate, incomplete, or unsuitable.
  2. AI-generated outputs do not constitute legal, medical, financial, or professional advice.
  3. You are solely responsible for reviewing, validating, and approving outputs prior to reliance or publication.
  4. Certain features may operate autonomously when enabled by you.

StackedAI disclaims responsibility for reliance on AI-generated outputs.

4. Automated Publishing & Invocation Controls

Certain Services may allow automated execution, reporting, or publishing.

If you enable automation:

  • You expressly authorize automated generation and distribution.
  • You assume responsibility for supervising automation settings.
  • You acknowledge that automated actions may occur without manual confirmation.
  • You may disable automation unless restricted by enterprise contract.

StackedAI is not responsible for consequences of user-enabled autonomous publishing.

5. User Responsibilities

You agree not to:

  • Use the Services for unlawful purposes.
  • Generate illegal, harmful, abusive, or fraudulent content.
  • Attempt to bypass security controls.
  • Interfere with system integrity.
  • Reverse engineer proprietary systems.
  • Misrepresent authorship or system provenance.

You remain solely responsible for content created, deployed, or distributed using the Services.

6. Intellectual Property

6.1 User Content

You retain ownership of content you submit or generate using the Services.

You grant StackedAI a non-exclusive, worldwide, royalty-free license to host, process, store, and render such content solely for providing and improving the Services.

6.2 Company Property

All system architecture, frameworks, documentation, branding, code, models, templates, and infrastructure remain the exclusive property of StackedAI.

No license is granted except as expressly stated herein.

7. Logging & Traceability

StackedAI systems may generate structured logs, invocation records, metadata traces, and system activity histories.

These logs:

  • Are system-generated records.
  • May be used for auditing, compliance, and security.
  • Do not constitute legally binding certification unless expressly agreed in writing.

Users are responsible for compliance with recordkeeping obligations.

8. Data Security

StackedAI implements reasonable administrative, technical, and physical safeguards designed to protect data. However, no system can guarantee absolute security.

9. Confidentiality

Where applicable, StackedAI will treat non-public customer data as confidential and will not disclose it except:

  • To authorized subprocessors
  • As required by law
  • As necessary to provide the Services

Enterprise agreements may include additional confidentiality provisions.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

StackedAI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, StackedAI shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of revenue, profits, data, or business opportunity
  • Reliance on AI-generated outputs
  • User-enabled automated actions

Aggregate liability shall not exceed amounts paid to StackedAI in the preceding twelve (12) months.

12. Termination

StackedAI may suspend or terminate access for:

  • Violation of these Terms
  • Security risks
  • Non-payment
  • Illegal use

Users may terminate their accounts at any time.

13. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms periodically. Continued use constitutes acceptance of updated Terms.
